PRIVACY POLICY

This Privacy Policy describes how and when I collect, use, and share information when you purchase an item from me, contact me, or otherwise use my services.

This Privacy Policy does not apply to the practices of third parties I use that I do not own or control, including Etsy, Squarespace, Paypal, Royal Mail, Parcel2Go, Gmail, Google Analytics or MailChimp. You can reference the Privacy Policies from these 3rd parties to learn more about their privacy practices.

Information I Collect:

To fulfil an order, you provide me with certain information such as your name, email address, postal address, phone number, payment information, the details of the product that you’re ordering and any photographs you send me of your purchase in it's new home. I will not store or collect your payment card details. That information is provided directly to my third-party payment processors whose use of your personal information is governed by their Privacy Policy.

To book me for an event, you provide me with information such as your name, email address, phone number, payment information, postal address, the details of your event and any photos or video from the event that you give me consent to use.

To join my mailing list and/or to subscribe to my blog you provide me with your name and email address.

Usage Data - we may also collect information how the Service is accessed and used ("Usage Data"). This Usage Data may include information such as your computer's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

Why I Need Your Information and How I Use It:

I rely on a number of legal bases to collect, use, and share your information, including:

as needed to provide my services, such as when I use your information to fulfil your order, to settle disputes, or to provide customer support;

when you have provided your affirmative consent, which you may revoke at any time, such as by signing up for my mailing list and/or blog; We may use your Personal Data to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send.

Information about my customers is important to my business. I share your personal information for very limited reasons and in limited circumstances, as follows:

Service providers. I engage certain trusted third parties to perform functions and provide services to my shop, such as delivery companies. I will share your personal information with these third parties, but only to the extent necessary to perform these services.

Compliance with laws. I may collect, use, retain, and share your information if I have a good faith belief that it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce my agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of my customers, or others.

Data Retention:

I retain your personal information only for as long as necessary to provide you with my services and as described in my Privacy Policy. However, I may also be required to retain this information to comply with my legal and regulatory obligations, to resolve disputes, and to enforce my agreements. I generally keep your data for the following time period: 5 years.

Transfers of Personal Information Outside the EU:

I may store and process your information through third-party hosting services in the US and other jurisdictions. As a result, I may transfer your personal information to a jurisdiction with different data protection and government surveillance laws than your jurisdiction.

Security Of Data:

The security of your data is important to me, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While I strive to use commercially acceptable means to protect your Personal Data, I cannot guarantee its absolute security.

Children's Privacy

My Service does not address anyone under the age of 13 ("Children").

I do not knowingly collect personally identifiable information from anyone under the age of 13. If you are a parent or guardian and you are aware that your Children has provided me with Personal Data, please contact me. If I become aware that I have collected Personal Data from children without verification of parental consent, I will take steps to remove that information from my servers.

In such cases, I will delete your personal information unless I have compelling and legitimate grounds to continue using that information or if it is needed for legal reasons.

Complain. If you reside in the EU and wish to raise a concern about my use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.

1 Agreement to Terms

1.1 These Terms and Conditions constitute an agreement made between you and Jamie Sugg (sole trader), located at Beacon Cottage, Downing Farm, Station Road, Swaffham Bulbeck, Cambridge, CB25 0NW (we, us), concerning your access to and use of the Jamie Sugg website (https://www.jamiesugg.co.uk) as well as any related applications (the Site).

1.2 The Site provides the following: Online portfolio to show artwork and purchase of original art, prints and merchandise from us, and workshop and art residency information. You agree that by accessing the Site, you have read, understood, and agree to be bound by these Terms and Conditions.

1.3 You may not access or use the Site for any purpose other than that for which we make the site and our services available. The Site may not be used in connection with any commercial endeavours except those that are specifically endorsed or approved by us.

1.4 We reserve the right to modify or withdraw, temporarily or permanently, this website (or any part thereof) with or without notice to you; you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the website.

1.5 We reserve the right to change these conditions from time to time; your continued use of the website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check to determine whether the conditions have been changed.

2 Acceptable Use

2.1 All copyright is retained by the artist, Jamie Sugg. Images must not be resold or reproduced without the artist’s written permission.

2.2 No part of the Site, Services or Our Content may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

3 Content

3.1 The content on the Site is provided for general information only. It is not intended to amount to advice on which you should rely. You should obtain professional or specialist advice before taking, or refraining from taking, any action on the basis of the content on the Site.

3.2 Provided that you are eligible to use the Site, you are granted a limited licence to access and use the Site and Our Content and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use.

3.3 Every care has been taken to show the artwork as accurately as possible with regard to size and colour. The image you see may be different due to slight variation between browsers, devices and screen settings. Any variation between the image represented and the actual artwork is not deemed a fault and such inconsistencies will not be a valid reason for return.

3.4 There may be opportunities for you to post content to the Site or send feedback to us (User Content). You understand and agree that your User Content may be viewed by other users on the Site, and that they may be able to see who has posted that User Content.

4 Links to third party content

4.1 The Site may contain links to websites or applications operated by third parties. We do not have any influence or control over any such third party websites or applications or the third party operator. We are not responsible for any third party websites or applications or their availability or content.

4.2 We accept no responsibility for adverts or links contained within the Site. If you agree to purchase goods and/or services from any third party who advertises in the Site, you do so at your own risk.

4.3 The Site may contain affiliate links which will grant us a commission if you purchase from those sites.

5 Sales

5.1 Artwork listed may be withdrawn from sale at any point by the artist for reasons such as, but not limited to, sale elsewhere or withheld for exhibition display.

5.2 If you purchase physical goods from the Site, our terms and conditions of supply will apply to the sales.

6 Security of Data

6.1 We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure. We use a secure external payment process. In the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when ordering from the website.
